Competition record

Caesars Entertainment

Deep profile · 1 linked library matter

Caesars is the lead hotel defendant in the Atlantic City room-rate case. The Third Circuit revived those Rainmaker claims in July 2026.

Overview

Caesars Entertainment runs casino hotels, including properties in Atlantic City. Room rates there are the product in Gibson's sister case, not the Las Vegas case that was dismissed.

On July 29, 2026 the Third Circuit revived claims that hotels using Cendyn's Rainmaker software exchanged nonpublic occupancy data and followed the software's rates. Rehearing was denied on October 2, 2026.

Revival is not a verdict. The district court has the case again. The Las Vegas version, Gibson v. Cendyn, stays dismissed.

Competition footprint

Shared nonpublic occupancy data is the allegation that distinguished this case from a software vendor merely selling a tool.

Adherence to recommended rates is the plus factor the appellate court was willing to credit at the pleading stage.

Casino hotels also compete on gaming, entertainment, and loyalty. The live claim is about room rates.

Consumer & business angle

Guests pay the rate the hotel posts. They do not see whether a revenue system pooled a rival's occupancy.

Other Atlantic City hotels are alleged participants. Their own pricing staff remain the people who accept or override a recommendation.

What to watch

  • What the district court does on remand.
  • Any class-certification fight over Atlantic City guests.
