Express Scripts

Deep profile · 1 linked library matter

Express Scripts is the pharmacy benefit manager owned by Cigna, and it decides which drugs a health plan covers cheaply. The FTC's insulin rebate case against it settled on 4 February 2026, which was a settlement and not a trial verdict.

Overview

Express Scripts builds formularies, negotiates rebates with drug makers, and runs mail and specialty pharmacies for Cigna and for outside plans. Insulin has been the drug at the center of the FTC rebate case.

The Commission settled with Express Scripts on 4 February 2026. Caremark settled on 14 July 2026, and OptumRx is the respondent still left, with a proposed consent that is not yet a final order.

Express Scripts' own settlement ended the FTC case against it without a trial. It did not close the Optum portion of the docket.

Competition footprint

Formulary placement is the product: a preferred insulin gets the lower copay, and the manufacturer pays a rebate for that spot.

The 4 February 2026 settlement is a negotiated end to the Express Scripts charges, not a verdict.

OptumRx remained pending after both Express Scripts and Caremark settled.

Consumer & business angle

Patients pay the insulin copay the formulary sets, and employers are the clients that hire the pharmacy benefit manager.

Insulin makers negotiate the rebate that pays for preferred placement on the Express Scripts list.
